Live Infinite Software License Agreement and Terms of Service

• "Software" means the Live Infinite application (Electron App for Windows and macOS), the website (live-infinite.netlify.app), and all related services.
• "Coins" means virtual in-app currency used to pay for certain features within the system.
• "Profile" means a set of software configurations you create, consisting of Overlay settings, Event Triggers, Sound Alerts, and other related data.
• "Sync" means the process of comparing and transferring profile data between the desktop application and the cloud server using the Last-Write-Wins principle.
• "Subscription Plan" means the service tier you have chosen, being Free, Light, Pro, or Ultra. Each plan has different feature limits as specified on the web Pricing page.

2.1 Grant of License

The Provider grants you a license to use the Live Infinite Software as follows:

• Non-exclusive: Other persons may also be licensed to use the Software.
• Non-transferable: You may not transfer, sell, or sublicense your rights to any third party.
• Revocable: The Provider may revoke your license under the conditions specified in these Terms.
• Personal: The license is tied to your single user account.

2.2 Restrictions on Use

You strictly agree NOT to, nor permit any third party to:

1. Copy, distribute, or publish the Software without authorization.
2. Modify, translate, adapt, or create derivative works based on the Software.
3. Reverse engineer, decompile, disassemble, or attempt to extract the source code.
4. Sell, rent, distribute, or sublicense the Software for commercial purposes.
5. Attempt to access security systems, circumvent protective measures, or breach databases.
6. Use the Software for unlawful purposes, including streaming illegal content or infringing copyrights.
7. Share user accounts or use a single account on more devices than your Subscription Plan permits.

3.1 Account Registration

• You agree to provide registration information that is true, accurate, complete, and current.
• Use of false information or another person's identity may result in immediate account suspension or termination without prior notice.
• You must accept these Terms before creating an account.

3.2 Multiple Accounts

• Users are permitted to create only one (1) account per person. Creating multiple accounts to circumvent restrictions, abuse the coin system, exploit promotional offers, or evade bans is strictly prohibited and may result in all associated accounts being permanently banned.

3.3 Account Security

• The Software authenticates users via Firebase Authentication (by Google LLC).
• You are solely responsible for maintaining the confidentiality of your login credentials.
• Any action performed under your account is deemed your sole responsibility, whether or not you personally performed the action.
• If you suspect unauthorized access, you should change your password immediately and notify us through our support channels.

3.4 Two-Factor Verification

• The system requires email link verification for new account registrations.
• The system generates a Pairing ID between the desktop app and website with a 10-minute validity period.

4.1 Subscription Plans

• The Software offers four service tiers: Free, Light, Pro, Ultra. Feature limits for each plan are specified on the web Pricing page.
• When a subscription expires, your access to features will automatically downgrade to the Free plan level.
• Subscription renewals are NOT automatic. You must renew manually.

4.2 Billing

• Subscription fees are billed based on the billing cycle of the chosen plan.
• Payments are processed through licensed third-party payment providers.
• The Provider does NOT directly store credit card numbers, debit card numbers, or bank account information.

4.3 Cancellation of Subscription

• You may cancel your subscription at any time. Cancellation will take effect at the end of the current billing cycle.
• After cancellation, you will retain access to premium features until the end of the paid period, after which your account will revert to the Free plan.
• The Provider does not automatically renew subscriptions; therefore, subscriptions expire naturally at the end of the paid period.

4.4 Coin System

• Coins are virtual in-app currency used for certain feature services.
• Atomic Coin Deductions: The system uses Atomic database functions to prevent double-spend.
• Once a coin deduction is successfully processed, it is final and non-reversible, unless a verified system malfunction occurs.
• Coins have no real monetary value and cannot be exchanged, sold, or transferred.

4.5 Refund Policy

• All payments for subscriptions or coin purchases are final and non-refundable under all circumstances, including but not limited to early cancellation, change of mind, or dissatisfaction with the service.
• The sole exception is where mandatory consumer protection laws explicitly require otherwise.
• Users are responsible for cancelling their subscription before the end of the billing period. Forgetting to cancel, ceasing to use the Service, or no longer streaming does not constitute grounds for a refund.

5.1 Grounds for Suspension or Ban

The Provider reserves the right to suspend, restrict, or permanently ban your account without prior notice if:

• You violate any provision of these Terms.
• You create multiple accounts to circumvent restrictions or evade a previous ban.
• You engage in fraud, deception, or abuse of the coin system or promotional offers.
• You attempt unauthorized access to the system, including exploiting security vulnerabilities.
• You share your account or use it in a manner that violates Active Session restrictions.
• You use the Software for unlawful activities, including streaming illegal content.
• You harass, threaten, or abuse other users or Provider staff.
• You pose a security risk to the system or other users.
• You engage in any activity that disrupts or interferes with the Service.

5.2 Types of Enforcement Actions

• Warning: A formal notice of violation. Continued violation may result in further action.
• Temporary Suspension: Your account is temporarily disabled for a specified period. During suspension, you cannot access the Software or its features. Any active subscription continues to count down during the suspension period.
• Permanent Ban: Your account is permanently and irreversibly disabled. You will lose access to all features, profiles, coins, and subscription time. Permanent bans are not eligible for refund of any kind.

5.3 Appeal Process

• If you believe your account was banned or suspended in error, you may submit an appeal through our Discord Support Server within 14 days of the action.
• The Provider will review your appeal within 30 days and respond with a final decision.
• The Provider's decision on appeals is final and binding.

5.4 Ban Evasion

• Creating new accounts to evade a ban is strictly prohibited. If detected, all associated accounts will be permanently banned without the right to appeal.

6.1 Voluntary Account Deletion

• You may request deletion of your account at any time by contacting us through our Discord Support Server.
• You must verify your identity before deletion can proceed.
• Upon receiving a verified request, we will process the deletion within 30 days.

6.2 Effects of Account Deletion

• Account deletion is permanent and irreversible. Once deleted, your data cannot be recovered.
• All profile data, Event Trigger configurations, game profiles, and synchronization data will be permanently removed.
• Your Firebase Authentication account will be deleted.
• Any remaining subscription time or unused coins will be forfeited and are non-refundable.
• Shared game profiles you created may continue to exist but will be disassociated from your account.
• Transaction records required by law (tax/accounting) will be retained for the legally mandated period in anonymized form.

6.3 Termination by Provider

• The Provider may terminate your account in addition to banning as described in Section 5, particularly in cases of severe or repeated violations.
• Upon termination by the Provider, the effects described in Section 6.2 apply, except that any remaining subscription time or coins are forfeited without refund.

7.1 Profile Synchronization

• Profile data is automatically synchronized between the desktop application and cloud server using Last-Write-Wins.
• The Provider does not guarantee 100% sync success as it depends on your internet connection.

7.2 Ownership of the Software

• The Live Infinite Software, including source code, graphics, UI design, trademarks, and all related intellectual property, is the exclusive property of the Provider.
• These Terms only grant a license to use, not ownership.

7.3 User-Generated Content

• Profile configurations, Event Triggers, and game profiles you create are your data.
• You grant the Provider a license to store, process, and sync such data for service provision.
• Shared game profiles can be accessed by other users.

8.1 Use of Unofficial APIs

• The Software utilizes unofficial APIs (e.g., TikTok) to retrieve and display live stream data.
• By using our Service, you acknowledge that we are not affiliated with TikTok or any third-party platform.
• We cannot guarantee the accuracy, completeness, or reliability of data from external APIs.

8.2 Service Availability

• Live Infinite relies on external platform APIs. Changes by these platforms may affect Service availability.
• We will make reasonable efforts to adapt but cannot guarantee uninterrupted access.

8.3 Disclaimer of Warranties

• The Software is provided "As-Is" and "As-Available".
• The Provider makes no warranties that the Software will operate error-free, without interruption, that connections to external platforms will function continuously, that data will not be lost, or that the Software is free from viruses.

8.4 Limitation of Liability

• To the maximum extent permitted by law, the Provider's total liability shall be limited to the amount you paid during the 3 months preceding the event causing the damage.
• This applies regardless of the legal theory (contract, tort, strict liability, or otherwise).

8.5 Indemnification

You agree to defend, indemnify, and hold harmless the Provider from any claims, damages, or expenses arising from your violation of these Terms, violation of any law or third-party rights, or unlawful use of the Software.

9.1 Governing Law

These Terms shall be governed by the laws of the Kingdom of Thailand, without regard to conflict of laws principles.

9.2 Dispute Resolution

• Parties agree to first attempt good-faith negotiation.
• If unresolved within 30 days, disputes shall be submitted to the competent courts of Bangkok, Thailand.

10.1 Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and the Provider.

10.2 Severability

If any provision is found unenforceable, it shall be interpreted as narrowly as necessary, and remaining provisions continue in full effect.

10.3 Waiver

Failure to enforce any right does not constitute a waiver.

10.4 Force Majeure

The Provider is not liable for delays due to events beyond reasonable control, including natural disasters, war, pandemics, internet disruptions, changes in external platform policies, or government orders.

10.5 Amendment of Terms

The Provider may amend these Terms from time to time with notice through appropriate channels. Continued use constitutes acceptance.

These Terms are available in Thai and English. In the event of any discrepancy, the Thai version shall prevail.
